I. GENERAL PROVISIONS
1. Words written in capital letters should be understood in accordance with their definition provided in the REGULATIONS of the MASZYNERIA.PL website.
2. THE ADMINISTRATOR of personal data collected through MASZYNERIA.PL is the SERVICE PROVIDER.
3. The USER’s personal data are processed in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation), hereinafter referred to as the GDPR.

II. PURPOSE OF PROCESSING AND LEGAL BASIS
1. Using MASZYNERIA.PL and concluding contracts for the provision of SERVICES, which involves the need to provide personal data, is completely voluntary. The data subject decides for himself whether he wants to start using the SERVICES.
2. The ADMINISTRATOR processes the personal data of the USERS of MASZYNERIA.PL in the case of:
2.1. execution of inquiries and orders, pursuant to art. 6 sec. 1 lit. b GDPR (performance of commercial contracts).
2.2. using the NEWSLETTER to send commercial information by electronic means. Personal data is processed after expressing a separate consent pursuant to art. 6 sec. 1 lit. a) GDPR. The information sent via the NEWSLETTER service may concern both the content of the SERVICE PROVIDER and entities cooperating with it (including advertising content),
2.3 using the contact form to deliver e-mail, pursuant to art. 6 sec. 1 lit. b GDPR (performance of the contract for the provision of electronic services in accordance with the REGULATIONS),
2.4. marketing and statistical.

III. TYPE AND SCOPE OF THE PROCESSED PERSONAL DATA
1. Type of personal data that may be processed by the ADMINISTRATOR:
1.1. name and surname,
1.2 company name,
1.3. address (street and house / flat number, postal code, city, voivodeship, country),
1.4. e-mail address
1.5. IP address
1.6. tax identification number
1.7. telephone number.
2. In the case of the NEWSLETTER, the following data may be processed:
2.1. name and surname,
2.2 company name,
2.3. address (street and house / flat number, zip code, city, voivodeship, country),
2.4. e-mail address
2.5. IP address
2.6. tax identification number
2.7. telephone number
3. The processing covers personal data and messages sent by the USERS when using the contact form.
4. The ADMINISTRATOR may also collect navigation data, including information about links that they decide to click or other activities undertaken at MASZYNERIA.PL. The legal basis for this type of activity is the legitimate interest of the ADMINISTRATOR (Article 6 (1) (f) of the GDPR), consisting in facilitating the use of electronic services and improving the functionality of these services.
5. When using MASZYNERIA.PL, the ADMINISTRATOR may process additional information, in particular: the IP address assigned to the USER’s computer or the external IP address of the Internet provider, network name, domain name, browser type, access time, operating system type and information stored on the USER’s device. .
6. Providing personal data by the USER is voluntary.
7. Personal data will also be processed in an automated manner in the form of profiling, provided that the USER agrees to it pursuant to art. 6 sec. 1 lit. a) GDPR. The consequence of profiling will be assigning a profile to a given person in order to make decisions about him or to analyze or predict his preferences, behavior and attitudes.
8. The ADMINISTRATOR takes special care to protect the interests of the data subjects, and in particular ensures that the data collected by him are:
8.1 processed in accordance with the law,
8.2 collected for specified, lawful purposes and not subjected to further processing inconsistent with these purposes,
8.3 factually correct and adequate in relation to the purposes for which they are processed and stored in a form that allows the identification of persons to whom they relate, no longer than it is necessary to achieve the purpose of processing.

IV. PERIOD OF PERSONAL DATA ARCHIVING
1. USERS ‘personal data is stored by the ADMINISTRATOR:
1.1. If the basis for data processing is the performance of the contract, as long as it is necessary to perform the contract, and after that time for a period corresponding to the period of limitation of claims. Unless a special provision provides otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business – three years.
1.2. If the basis for data processing is consent, as long as the consent is not revoked, and after revoking the consent for a period of time corresponding to the period of limitation of claims that may be raised by the ADMINISTRATOR and which may be raised against him. Unless a special provision provides otherwise, the limitation period is six years, and for claims for periodic benefits and claims related to running a business – three years.

V. SHARING OF PERSONAL DATA
1. The USERS ‘personal data is shared with trusted partners: MASZYNERIA.PL EKSPORT-IMPORT MASZYN Henryk Konieczko, ul. Cieplicka 149 A, 58-570 Jelenia Góra, NIP: PL 6111473880, and Santander Leasing S.A.,
2. The USERS ‘personal data is transferred to service providers used by the ADMINISTRATOR to run MASZYNERIA.PL. Service providers to whom personal data are transferred, depending on contractual arrangements and circumstances, either are subject to the ADMINISTRATOR’s instructions as to the purposes and methods of processing this data (processors) or independently define the purposes and methods of their processing (administrators).
3 . USERS ‘personal data is stored only within the European Economic Area (EEA).
4. To keep statistics, the SERVICE PROVIDER may also use the services of other companies, e.g. Google and Facebook.

VI. THE RIGHT TO CONTROL, ACCESS AND CORRECT YOUR OWN DATA
1. The USER to whom the data relates has the right to access their personal data and the right to rectify, delete, limit processing, the right to transfer data, the right to object, the right to withdraw consent at any time without affecting the lawfulness of the processing that was carried out on the basis of consent before its withdrawal.
2. Legal grounds for the USER’s request:
2.1. Access to data – art. 15 GDPR
2.2. Data rectification – art. 16 GDPR.
2.3. Deletion of data (the so-called right to be forgotten) – art. 17 GDPR.
2.4. Restriction of processing – art. 18 GDPR.
2.5. Data transfer – art. 20 GDPR.
2.6. Objection – Art. 21 GDPR
2.7. Withdrawal of consent – art. 7 sec. 3 GDPR.

4. In the event of the USER having the right resulting from the above rights, the ADMINISTRATOR fulfills the request or refuses to comply with it immediately, but no later than within one month after receiving it. However, if – due to the complexity of the request or the number of requests – the ADMINISTRATOR will not be able to meet the request within one month, it will meet them within the next two months, informing the USER within one month of receiving the request – about the intended extension of the deadline and its reasons.
5. If it is found that the processing of personal data violates the provisions of the GDPR, the data subject has the right to lodge a complaint with the President of the Office for Personal Data Protection.

VII. “COOKIES”
1. MASZYNERIA.PL uses “cookies”.
2. The installation of “cookies” on the USER’s device is necessary for the proper provision of the SERVICES and for statistical purposes.
3. The USER has the right to decide on the access of “cookies” to his computer by selecting them in advance in the settings of his browser. Detailed information on the possibilities and ways of handling “cookies” is available in the software (web browser) settings. Failure to change the settings in the USER’s browser is tantamount to agreeing to their use.
4. The website uses two types of “cookies”: “session” and “permanent”.
4.1. “Session” cookies are temporary files that are stored on the USER’s end device until logging out (leaving the website).
4.2. “Permanent” cookies are stored on the USER’s end device for the time specified in the parameters of “cookies” or until they are deleted by the USER.
5. The ADMINISTRATOR may use its own cookies in order to better understand how the USERS interact with MASZYNERIA.PL. The files collect information on how the USER uses the website, the type of website from which the USER was redirected and the number of visits and the duration of the USER’s visit to the website. This information does not record the User’s specific personal data, but is used to compile statistics on the use of the website.
6. The ADMINISTRATOR may use third-party marketing and analytical tools on its website, e.g.
6.1 Marketing tools, such as Facebook Pixel, to direct advertisements to the USER. This is related to the use of “cookies” by Facebook, as part of the “cookie” settings, the USER may decide whether he agrees to the use of the Pixel Facebook tool by the SERVICE PROVIDER (administrator: Facebook Inc. or Facebook Ireland Limited) in relation to him;
6.2 Analytical tools, i.e. Google Analytics, this involves the use of “cookies” by Google LLC regarding the Google Analytics service, as part of the mechanism for managing cookie settings, the USER has the option to decide whether the SERVICE PROVIDER will be able to use Google Analytics (external cookie administrator: Google Inc. based in the USA) in relation to him.

VIII. FINAL PROVISIONS
1. The ADMINISTRATOR uses technical and organizational measures to ensure the protection of the processed personal data appropriate to the threats and categories of data protected, in particular, protects the data against unauthorized disclosure, removal by an unauthorized person, processing in violation of applicable laws and change, loss, damage or destruction. 2. ADMINISTRATOR provides appropriate technical measures to prevent the acquisition and modification by unauthorized persons of personal data sent electronically.
3. In matters not covered by this PRIVACY POLICY, the provisions of the GDPR and other relevant provisions of Polish law shall apply accordingly.
